2. Description of Service
Spotlight provides AI visibility analysis to help brands understand how they appear in AI responses across different platforms. We monitor AI platforms and provide insights and analytics about brand mentions and sentiment.
3. User Accounts
To access certain features of the service, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to use the service to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of others
- Transmit harmful or malicious code
- Interfere with or disrupt the service or servers
- Attempt to gain unauthorized access to any part of the service
5. Intellectual Property Rights
The service and its content, features, and functionality are owned by Spotlight and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without express written permission.
6. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. Spotlight is not responsible for any data inaccuracies, system downtime, or bugs in the system. Due to the probabilistic nature of large language models (LLMs), all data, analysis, and results provided by Spotlight are subject to inherent limitations. Users should expect a typical error margin of 5-10%, and in some cases, the error margin may be higher. Data and insights generated by Spotlight are not guaranteed to be 100% accurate or complete, and should not be solely relied upon for critical decisions.
7. Use of Data, Research, and Marketing
By using the service, you agree that Spotlight may use data generated in user reports, including but not limited to analysis results, for research purposes, case studies, and to improve our services. Spotlight may also mention your brand name and reference your use of the service in case studies, marketing collateral, and other promotional materials, unless you explicitly request otherwise in writing.
8. Indemnification
You agree to indemnify, defend, and hold harmless Spotlight and its affiliates, officers, agents, employees, and partners from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
9. Limitation of Liability
To the maximum extent permitted by law, Spotlight shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if Spotlight has been advised of the possibility of such damages. Spotlight's total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount paid by you, if any, for accessing the service during the twelve (12) months preceding the claim.
10. Termination
We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately.
11. Changes to Terms
We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the service after revisions become effective, you agree to be bound by the revised Terms.
12. Cancellation and Refund Policy
If you cancel your plan, your access and benefits will remain active until the end of your current billing cycle. No refunds will be issued for any unused portion of the billing period. All payments are non-refundable.

Spotlight is committed to complying with the General Data Protection Regulation (GDPR) and all applicable EU privacy laws. If you are located in the European Union, you have certain rights regarding your personal data, including the right to access, correct, delete, restrict processing, object to processing, and data portability.
